Privacy provisions for the consumer/user of the gift card

RestoManager (hereinafter "The Provider") considers guaranteeing privacy and data protection very important. With this privacy statement (hereinafter "Privacy Statement"), the Provider wishes to inform the user in detail about the processing of their personal data and associated rights when using the website www.restomanager.net and www.restotakeout.com.

By using certain functions of the Website, the Provider receives your personal data, which it will process with respect for the user's privacy and in compliance with the law of 8 December 1992 on the protection of privacy with regard to the processing of personal data, which from 25 May 2018 will be replaced by the General Data Protection Regulation (GDPR).

By accepting the detailed privacy statement, general consent is given to all processing described in this privacy statement for which consent is required.

General provisions for the consumer/user of the gift card

1. The gift card entitles the holder to the amount stated on the gift card and paid for receiving the voucher. RestoManager is not responsible for the goods or services the customer pays for with the purchased gift card.

2. The gift card can be redeemed within one year of purchase on a day and time of your choice at the restaurant where the gift card was purchased. The consumer can under no circumstances and under no conditions exchange the purchased gift card for money with RestoManager. The gift cards are only valid until the date stated on the gift card – typically this is 1 year after purchase. The gift cards are valid exclusively at the merchants currently listed on the gift card.

3. The prices listed on the gift card are expressed in euros and exclusively entitle the holder to the arrangement stated on it. No VAT applies to the voucher.

4. The value of a gift card cannot be exchanged for money, only for products/services. When using the gift card for products/services of lower value than the gift card value (for example, making purchases of EUR 30 with a gift card of EUR 50), the difference cannot be refunded in money. However, a remaining value stays on the gift card that can be used later, and only at the restaurant where the gift card was purchased.

5. The consumer must carefully store the gift card. Under no circumstances can RestoManager be obliged to produce a duplicate of the purchased gift card.

6. RestoManager is not responsible if the customer enters an incorrect email address of the Beneficiary. Furthermore, RestoManager bears no responsibility if the gift card, accidentally or otherwise, falls into the hands of a third party after dispatch.

7. RestoManager is not responsible for problems with the execution of the payment by the Customer. RestoManager uses the professional services of Mollie to ensure the security of online payments. The consumer does not have the right to withdraw from the purchase once payment is completed.

8. RestoManager is in no case responsible for reimbursement of restaurants or businesses that have gone bankrupt, making gift cards no longer usable.

Nor shall RestoManager be obliged to provide a new gift card to the consumer, nor to reimburse the costs of a lost/stolen/damaged or unauthorised gift card in any form. In other words: the gift card can be downloaded once only without any exception. Expired vouchers cannot be refunded to the consumer/user. Even when a restaurant goes bankrupt or no longer collaborates with RestoManager, RestoManager cannot be held responsible for issuing a new gift card for that same restaurant or another restaurant.

RestoManager reserves all rights in this regard.

In case of deceit, fraud, forgery, swindling or other acts committed in bad faith or suspicion of any of the aforementioned acts, RestoManager has the right to dissolve the purchase of the gift card or to suspend the execution of the gift card, without payment of compensation.

Any violation will result in total exclusion from the website www.RestoManager.net in its entirety. Any violation of criminal law will be immediately reported by RestoManager to the competent authorities.

Final provisions – Exoneration

RestoManager makes all reasonable efforts to provide accurate and current information on the website www.restomanager.net and on the issuance of the gift card. All information displayed on the website is expressly subject to printing or other errors.

RestoManager cannot be held liable for any form of damage resulting from inaccuracies or incompleteness in the information offered on the gift card and/or on the website www.restomanager.net or other websites of companies where gift cards are traded through RestoManager.

RestoManager makes every effort to keep the web application and/or gift card modules online and cannot be held liable for possible technical disruptions due to the internet or the internet provider, nor for the person wishing to purchase a gift card nor for the restaurant offering them.

RestoManager exonerates itself from any form of damage resulting from the use of data, advice or ideas provided by or on behalf of RestoManager via the website RestoManager.net or websites of users of the gift card module.

The RestoManager website (www.restomanager.net) may contain hyperlinks and references to other websites. Such hyperlinks and references are included solely for the information of the consumer and customer. RestoManager accepts no responsibility and cannot be held liable for any form of damage resulting from the content of the website that can be visited via a hyperlink or to which reference is made.
